1. General provisions

1.1. This agreement is an official and public offer by the Seller to conclude a contract for the sale of Goods posted on the website senerawear.com (hereinafter referred to as the Website).

1.2. The Buyer's personal data is not disclosed to third parties, but is stored for the purpose of providing the service of selling goods presented on our website. The senerawear online store reserves the right to use this information for marketing purposes (analysis of sales data, customer segmentation, analysis of website traffic, advertising mailings to customers).

1.3. By confirming an order in the senerawear online store, the Buyer agrees to provide reliable and accurate information about themselves and their contact details.

1.4. By placing an order on the senerawear website, the Buyer agrees to these terms and conditions.

 

 

2. ACCEPTANCE AND PROCESSING OF ORDERS

 

2.1. Orders are accepted via the senerawear website, as well as by phone. The phone number is listed in the Contacts section and on Instagram, as indicated on the website.

2.2. If an order is placed via the website during business hours (Monday-Friday from 9:00 a.m. to 7:00 p.m.), a representative of the online store will confirm the order within one business day. If the order is placed outside of business hours, on weekends, or on holidays, a representative of the online store will contact the Buyer during the next business hours to confirm the availability of the product, payment terms, and delivery of the order.

2.3. The order is not considered complete if the Buyer has not received confirmation of their order by SMS and/or email in the form of a letter and/or receipt confirming the purchase.

 

3. DELIVERY AND PAYMENT

3.1 Terms of payment and delivery of goods to the Buyer

are regulated by the section Delivery and Exchange

3.2. In case of non-receipt of funds, the online store reserves the right to cancel the Order.

 

4. QUALITY GUARANTEES AND RETURNS

4.1. We guarantee that all goods presented in the online store are new and correspond to the description posted on the website.

The warranty period for goods is 14 calendar days. If defects are found in the goods, the Buyer has the right to have the defects eliminated free of charge, to exchange the goods, or to receive a refund in accordance with the Law of Ukraine “On Protection of Consumer Rights.”

4.1. The Buyer has the right to refuse the goods after receiving them within 14 days. Return of goods of good quality is possible if their marketable appearance and consumer properties are preserved, as well as the document confirming the fact and conditions of purchase of these goods.

5. Rights and obligations of the parties:

5.1. The seller has the right to:

- terminate the contract in case of non-fulfillment of obligations by the buyer (for example, lack of payment) or in case of absence of goods in stock, having previously notified the buyer.

5.2. The buyer is obliged to:

- pay for and receive the order in a timely manner under the terms of this contract.

5.3. The Buyer has the right to:

- place an order in the online store;

- place an order in the Instagram store specified on the website.

- place an order by phone specified on the website.

- conclude an electronic contract;

- require the Seller to fulfill the terms of this Contract.

- terminate this agreement at any time prior to the shipment of the goods by notifying the Seller in a convenient manner (by phone or email). In this case, the Seller shall refund the full amount within 5 business days, and the funds shall be returned to the same card from which the payment was made within 10 days.

6. Responsibility of the parties

 

6.1. The parties shall be liable for failure to fulfill or improper fulfillment of the terms of this agreement in accordance with the procedure provided for in this agreement and the current legislation of Ukraine.

6.2. The Seller shall not be liable for:

- changes in the appearance of the Goods made by the manufacturer;

- minor discrepancies in the color range of the Goods, which may differ from the original Goods solely due to different color rendering of monitors of personal computers, phones, tablets of certain models;

- the content and accuracy of the information provided by the Buyer when placing an order;

- delays and interruptions in the provision of Services (order processing and delivery of goods) that occur for reasons beyond its control;

- unlawful illegal actions committed by the Buyer using this access to the Internet;

- for the transfer by the Buyer of their network identifiers - IP, MAC addresses, login and password to third parties;

6.3. The Buyer, using the Internet access provided to them, is solely responsible for any damage caused by their actions (personally, even if another person was using their login) to individuals or their property, legal entities, the state, or moral principles.

6.4. In the event of force majeure circumstances (military actions, natural disasters, terrorist acts, disruptions in the work of transport or postal services, etc.), the parties are released from the terms of this agreement. In this case, the terms of fulfillment of obligations may be postponed for the duration of the force majeure. For the purposes of this agreement, force majeure circumstances are understood to be events of an extraordinary, unforeseeable nature that exclude or objectively prevent the performance of this agreement, the occurrence of which the Parties could not have foreseen or prevented by reasonable means. 6.5. The Parties shall be liable for non-performance or improper performance of the terms of this agreement in accordance with the provisions of the Law of Ukraine “On Protection of Consumer Rights” and other applicable regulations.

In the event of disputes, the Parties shall attempt to resolve them through negotiations. If no agreement can be reached, the dispute shall be resolved in court in accordance with the laws of Ukraine. In the event of a breach of obligations regarding payment or delivery of goods, the Party in breach shall compensate the other Party for losses in full.

 

7. Other terms

7.1. The Buyer undertakes to carefully read this Agreement. If the Buyer does not agree with its terms, the Buyer undertakes to immediately stop using the Website.

7.2. When quoting materials from the Website, including copyrighted works, a link to the Website is mandatory.

7.3. The senerawear online store reserves the right to unilaterally change the terms of this Agreement and make changes to this agreement, provided that it is published on the website in advance.

7.4. The online store reserves the right to expand and reduce the product range on the Site, regulate access to the purchase of any goods, and suspend or terminate the sale of any goods at its own discretion.

7.5. This Offer applies to individuals who make purchases for personal use. Separate terms and conditions may apply to legal entities under an individual agreement.

 

8. Term of the agreement

8.1. The electronic agreement is considered concluded from the moment the person who sent the offer to conclude such an agreement receives a response accepting this offer in accordance with the procedure established by part six of Article 11 of the Law of Ukraine “On Electronic Commerce.”

8.2. Before the end of the term, this Agreement may be terminated by mutual agreement of the parties before the actual delivery of the goods, by returning the funds.

8.3. The parties have the right to terminate this agreement unilaterally in case of failure by one of the parties to fulfill the terms of this Agreement and in cases provided for by the current legislation of Ukraine.
